Hosey, a reporter for Patch.com in Illinois, has balked at an order to reveal the identity of a confidential source. As a result, Will County Judge Gerald Kinney found the journalist guilty of "minor direct criminal contempt." The judge says Hosey, a 10-year reporting veteran, must pay $1,000 in court costs, additional fines of $300 a day for three months and, after that, spend up to three months in jail.
Luckily, the penalty has been stayed while Hosey appeals. But that hardly alters the fact that the decision is a horrendous example of judicial overreaching. Especially since there is absolutely no indication that the information Hosey disclosed has had a negative impact on anything.
David Cuillier, president of the Society of Professional Journalists, has decried the ruling as "an absolute outrage and an affront to a free press and everything this nation holds dear." I couldn't agree more. Cuillier, a former reporter and editor who teaches journalism at the University of Arizona, says the situation is something he'd expect to encounter in a Third World nation, not in the great state of Illinois.

Well, as it turns out, the snake that bit L&L Energy, Inc. (NASDAQ:LLEN) and Sovereign Lithium Inc. (OTCMKTS:SLCO) didn't end up biting Makism 3D Corp. (OTCMKTS:MDDD). And in retrospect, that's probably how it should be. Indeed, the fact that MDDD didn't even come close to suffering the same fate as SLCO or LLEN did may be the biggest assurance Makism 3D fans could hope for that the company is everything it says it is.

In retrospect, their pullbacks come as no real surprise. Neither Voxeljet AG (NYSE:VJET) nor Camtek LTD. (NASDAQ:CAMT) saw their shares soar on any news that was meaningfully sustainable, and after the "shoot first, ask questions later" market had a chance to start asking questions, it became clear that - even with the largest of glimmers of corporate progress unveiled a few weeks ago - CAMT and VJET both had been bid up more on hype and less on substance. Meanwhile (and this could be bitterly ironic to some), a small cap play in the same 3D printing space that (1) didn't beat the daylights out of its hype-drum, and (2) is actually much closer to bringing a revenue-bearing product to the market [per today's news - more on that below] isn't getting anywhere near the same attention. That company? Makism 3D Corp. (OTCBB:MDDD). The good news is, MDDD finally looks like it's revving its engine, while Camtek and Voxeljet AG shares continue to deteriorate.

Another technology player that looks ready to trigger a big breakout trade is Fusion-IO (FIO), which is a provider of data-centric computing solutions. This stock has been hammered by the bears so far in 2013, with shares off by 38%.
If you take a look at the chart for Fusion-IO, you'll notice that this stock has been uptrending modestly over the last month, with shares moving higher from its low of $13.05 to its recent high of $14.78 a share. During that uptrend, shares of FIO have been consistently making higher lows and higher highs, which is bullish technical price action. That move has now pushed shares of FIO within range of triggering a big breakout trade.
Traders should now look for long-biased trades in FIO if it manages to break out above some near-term overhead resistance levels at $14.40 to $14.90 a share, and then once it takes out its 200-day moving average at $15.22 a share to more resistance at $15.50 to $16 with high volume. Look for a sustained move or close above those levels with volume that hits near or above its three-month average action of 3.69 million shares. If that breakout hits soon, then FIO will set up to re-fill some of its previous gap down zone from May that started near $19 a share. Shares of FIO could even tag $20 to $22 if that gap gets filled with strong upside volume flows.
Traders can look to buy FIO off any weakness to anticipate that breakout and simply use a stop that sits right below some near-term support levels at $13.55 to $13 a share. One could also buy FIO off strength once it takes out those breakout levels with volume and then simply use a stop that sits a comfortable percentage from your entry point.
